These Terms of Service govern your access to and use of ChalkyPapers (“Website”) and the academic assistance services offered through it (the “Services”). This document constitutes a legally binding contract between you (“User”, “you”, or “your”) and the operator of the Website (“we”, “us”, or “our”), which is owned and operated by .

By accessing or continuing to use the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety, without modification or reservation. If you do not agree with any provision of these Terms of Service, you must immediately discontinue use of the Services. By using the Website, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement under applicable Australian law.

These Terms of Service are governed by and construed in accordance with the laws of Australia, including applicable Commonwealth and State or Territory legislation, such as the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law, to the extent applicable.

Our Products and Services

ChalkyPapers provides academic assistance services delivered by qualified experts to support users across a range of subjects and educational levels. The Services are provided on a request-based basis and are intended to assist users with managing academic tasks, improving general academic skills, and understanding course-related requirements through individualised support.

All products and services provided through the Website are offered solely for reference, research, and educational support purposes. They are not intended to be submitted as original work in fulfilment of academic requirements where such submission would breach institutional policies, academic integrity standards, or applicable laws.

Permitted Use of Services and Products

At ChalkyPapers, all forms of plagiarism, fraudulent conduct, and academic dishonesty are strictly prohibited. We comply with Australian copyright laws, including the Copyright Act 1968 (Cth), and expect all users of the Website and Services to do the same.

  • The academic materials provided through ChalkyPapers are for personal, non-commercial use only. ChalkyPapers retains full copyright over all content. Users must not present any material obtained from ChalkyPapers as their own work. Where text or ideas from ChalkyPapers’ materials are used, proper citation and attribution to the Website is required.
  • Content created by our experts is provided solely for educational and learning purposes. Users do not acquire any rights to publish, distribute, reproduce, or otherwise exploit such content. All intellectual property rights remain vested in ChalkyPapers.
  • Editing and proofreading services offered by ChalkyPapers are intended to improve clarity, structure, and accuracy of user-submitted materials. Users may rely on feedback and edits for learning purposes but must not submit edited papers as their own original work.

Restrictions for Users

ChalkyPapers does not discriminate against users or visitors on the basis of race, gender, ethnicity, age, or religious belief. Certain behaviours, however, are considered harmful or unacceptable and may result in legal consequences under applicable Australian law.

By using the Website or Services, you agree to comply with all applicable laws and regulations. The following actions are expressly prohibited:

  • Sending unsolicited or unauthorised messages (spam) to ChalkyPapers or its users.
  • Hacking, attempting to hack, or otherwise interfering with ChalkyPapers or other online systems in a manner that misrepresents their association with ChalkyPapers.

  • Collecting, storing, disclosing, or using another person’s personal information obtained through the Website without lawful authority or consent.

  • Transferring, selling, or otherwise assigning your account, username, or password without prior written consent from ChalkyPapers.
  • Registering multiple accounts or registering under a different username while already holding an active account.
  • Introducing or deploying malicious software, including viruses, worms, trojans, or logic bombs, that may damage ChalkyPapers, its systems, or its users.
  • Attempting unauthorised access to ChalkyPapers, its servers, or related systems.
  • Posting, uploading, or transmitting content that may harm the Website, the Services, or other users.
  • Uploading content that infringes copyright, patent, trade mark, or other intellectual property rights of third parties.
  • Republishing, redistributing, or making available ChalkyPapers content in any print or digital format, including on other websites, without prior permission.
  • Engaging in any conduct that breaches these Terms of Service or violates applicable Australian law.

Any prohibited activity may result in the suspension or termination of your access to the Website or Services and may give rise to legal action or other remedies available under Australian law, including under the Criminal Code Act 1995 (Cth), the Copyright Act 1968 (Cth), and applicable privacy and consumer protection legislation.

Fees and Payment

Transparent Pricing

Service fees are determined based on the scope, complexity, and urgency of the user’s request. All costs associated with an order, including applicable taxes, are clearly disclosed prior to payment. No hidden or undisclosed charges are applied. A 12% service fee is automatically included in the price. Any changes affecting pricing, including custom requests outside standard offerings, will be communicated to the user for explicit approval before proceeding. The countdown to an order’s deadline begins only after payment has been successfully processed and all required instructions and reference materials have been received.

Accepted Payment Methods

ChalkyPapers accepts secure payment methods, including major credit and debit cards issued in Australia, PayPal, Apple Pay, Google Pay, and wire transfers. All charges are processed in Australian dollars (AUD), and applicable taxes may apply. Payment in full is required prior to the assignment of an expert or the provision of any educational services. Failure to complete payment may result in delays or non-delivery of services.

Payment Confirmation and Invoicing

Upon successful payment, users will receive an email confirmation containing a transaction receipt and invoice. Additional invoices for administrative, educational, or organisational purposes may be provided upon request. All payments are final except as otherwise stated in these Terms or required under applicable Australian law. Users are responsible for providing accurate payment information and for any fees, errors, or delays imposed by their payment provider.

Refunds and Cancellations

Users may request a refund or cancellation in accordance with the Refund Policy published on the Website. Refunds are issued at the discretion of ChalkyPapers and are subject to verification of the order status and compliance with these Terms. Partial refunds may apply where work has already commenced. All refund or cancellation requests must be submitted to [email protected] and include sufficient information to identify the relevant order.

All refund and cancellation procedures are conducted in accordance with applicable Australian consumer protection legislation, including the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Verification

ChalkyPapers reserves the right to request verification of billing or order-related information, either by phone or in writing. This verification process may be initiated within two (2) hours of payment confirmation.

Failure to complete the verification process within a reasonable timeframe may result in delays in the delivery of services.

All verification procedures are conducted to prevent unauthorised transactions and to ensure compliance with applicable Australian financial, fraud-prevention, and consumer protection requirements.

Refund Policy

If ChalkyPapers is unable to allocate an expert to provide the requested services, a full refund will be issued. Refunds are processed using the same payment method used for the original transaction. Where payment was made via direct deposit or wire transfer, credit may be applied to a future order, subject to user agreement.

All refunds are issued in accordance with this Refund Policy and applicable Australian consumer protection legislation, including the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth).

Circumstances Eligible for Refunds

Refunds may be issued in the following circumstances:

  • The services provided do not correspond to the instructions agreed upon at the time of order.
  • Duplicate or erroneous payments have been made.
  • Delivery of services exceeds the agreed timeframe without the User’s consent.

Refunds may be full or partial, depending on the extent of services already rendered.

Requesting a Refund

To request a refund, Users must contact [email protected] and provide:

  • Full legal name.
  • Order reference number.
  • Description of the issue.
  • Supporting documentation, where applicable.

Refund requests must be submitted within seven (7) calendar days of receiving the completed services. Requests submitted after this period will not be considered.

All requests are reviewed, and a response is issued within ten (10) business days.

Evaluation of Refund Requests

Refunds are granted only where a verified discrepancy is confirmed. A refund request may be denied where:

  • Instructions provided by the User were incomplete, unclear, or contradictory.
  • The User approved the services provided.
  • The request falls outside the permitted timeframe.

Approved refunds are processed using the original payment method within ten (10) business days.

Appeal Procedure

If a User disputes a refund decision, a secondary review may be requested by replying to the original correspondence with “Refund Appeal” in the subject line.

Appeals are reviewed by senior management, and a final decision is issued within ten (10) business days.

Exceptions and Limitations

  • Refunds are not available for discounted services, promotional offers, or special pricing unless explicitly stated.
  • Users are responsible for providing accurate payment and contact information. Failure to do so may delay or prevent refund processing.
  • All refund procedures are conducted in accordance with Australian consumer protection laws governing digital services, online transactions, and fair trading practices.

Deadline Extension by a Customer

If you choose to allow additional time for an expert to complete your order, ChalkyPapers will set a revised deadline accordingly. Any pricing adjustment resulting from the extended deadline will be calculated based on the updated timeframe and communicated to you prior to continuation of the Services.

Completed Product Delivery

  • Once your order is completed, the finished product will be delivered to the email address provided during registration on the Website. You may also access and download the completed product directly through your Customer Admin Panel.
  • If you experience any difficulty accessing or downloading the completed product, you should contact ChalkyPapers support. Our representatives will provide reasonable assistance to resolve technical issues and ensure delivery of the product as ordered.
  • ChalkyPapers is not responsible for delays or delivery failures caused by third-party email services, internet service providers, system outages, or other factors beyond our reasonable control.

Discounts and Account Balance

ChalkyPapers.com may offer special promotions, discounts, or incentive programmes to users from time to time. Unless expressly stated otherwise, discounts may be applied to a single order only and may not be combined with other promotional offers. Once applied, discounts have no cash value and are not refundable or exchangeable.

Users may add funds to their account balance for future use. The balance is denominated in Australian dollars (AUD). Account balance funds may be applied to eligible orders and, where expressly permitted, may be used in conjunction with certain discount offers. If funds are added to the account but remain unused, the user may request a refund in accordance with these Terms and applicable law. Once account balance funds have been applied to an order, they are non-refundable, except where required under the Australian Consumer Law.

Free Revision Guarantee

If you believe that revisions to your order are required, you may request amendments at no additional cost under our Free Revision Guarantee. Revision requests must be submitted in writing via email or through the Customer Admin Panel within fourteen (14) days of delivery of the completed order. Users subscribed to the 1st Class and Superior plans may request revisions within ninety (90) days and forty-five (45) days, respectively.

If a revision request is not submitted within the applicable time frame, the order will be deemed accepted, and the user will no longer be eligible for free revisions.

The time required for academic experts to complete revisions is not included in the original delivery deadline. Where revision instructions materially differ from or contradict the original order instructions, or where the applicable revision period has expired, ChalkyPapers.com reserves the right to charge an additional fee. Any such fee will be assessed on a case-by-case basis, taking into account the scope and complexity of the requested changes.

Where a revision is requested under the Free Revision Guarantee, the additional time required to complete and deliver the revised product will not be considered a delay for the purposes of any refund or satisfaction guarantee, except where required by the Australian Consumer Law.

Zero Plagiarism and AI-Written Text Guarantee

ChalkyPapers guarantees that all completed orders are free from plagiarism and AI-generated content. Each order undergoes thorough checks using industry-standard plagiarism detection software and AI content detection tools prior to delivery.

If plagiarism or machine-generated text is identified in your completed order, you may request a full refund after providing sufficient proof. Acceptable proof may include, but is not limited to:

  • An independent plagiarism report with direct links to the original sources
  • A report with links and appropriate annotations clearly demonstrating the plagiarism or AI-generated content

Please note the following exceptions:

  • Standard academic expressions, commonly used phrases, or similarities in references do not constitute plagiarism and will be excluded from any plagiarism calculations
  • Minor or software-detection errors, including false positives from plagiarism or AI detection tools, are not covered under the Zero Plagiarism Guarantee

All guarantees and refund procedures are subject to verification and are conducted in accordance with applicable Australian consumer protection legislation, including fair business and digital service practices. Relevant laws include:

  • The Australian Consumer Law (ACL) contained in the Competition and Consumer Act 2010 (Cth), which regulates misleading or deceptive conduct and consumer guarantees for services;
  • Applicable state and territory fair trading legislation, which governs consumer rights and dispute resolution for digital services and contracts.

Order Cancellation Initiated by a Customer

You may cancel an order at any time before making payment.

If you have paid for an order but no academic expert has been assigned, you may cancel and receive a refund of 80% of the payment.

If an academic expert has already been assigned to your project, but you choose to cancel, a refund of 40% of the total payment will be issued.

Refunds are processed in accordance with the methods outlined in our Refund Policy and are subject to verification.

Prohibited Jurisdictions

Access to ChalkyPapers.com and use of our Services is strictly prohibited for citizens, residents, or entities located in the following jurisdictions, or representing such entities:

  • Iran
  • North Korea
  • Syria
  • Sudan

By using the Website or Services, you acknowledge that any violation of this clause authorises ChalkyPapers to take immediate action, including but not limited to:

  • IP banning
  • Termination of accounts
  • Cessation of communication

To ensure compliance, ChalkyPapers does not advertise or promote its products or services in any form or through any media within the listed Prohibited Jurisdictions.

Disclaimer

ChalkyPapers provides its Services for educational and reference purposes only. While reasonable efforts are made to ensure accuracy, reliability, and functionality:

  • We do not guarantee that the Website or Services will meet your expectations or achieve any specific results.
  • We do not warrant that the Website will be operational at all times, or free from viruses, malware, or other harmful components.
  • We do not guarantee the reliability, quality, or timeliness of third-party services integrated with or referenced by our Website.
  • Use of any materials from the Website does not constitute a recommendation or guidance for any particular purpose.
  • ChalkyPapers is not responsible for any errors, omissions, or inaccuracies in content uploaded by Users.

These disclaimers are made in accordance with Australian federal and state legislation, including:

  • Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), which governs misleading or deceptive conduct and guarantees relating to digital services;
  • State and Territory Fair Trading or Consumer Protection Acts, which regulate online and digital service transactions and consumer rights, including remedies for defective or misrepresented services.

Dispute Resolution

The formation, interpretation, and enforcement of these Terms, as well as any disputes arising from or relating to them, shall be governed by the laws of Australia and, where applicable, the law of the state or territory in which the User resides, without regard to conflict-of-law principles.

Any legal action or proceeding arising out of or relating to these Terms or the use of ChalkyPapers shall be brought exclusively in the courts of the state or territory in which the User resides. By using ChalkyPapers, you consent to the personal jurisdiction of such courts and waive any right to a jury trial in proceedings related to this Agreement, to the extent permitted under Australian law.

All dispute resolution procedures shall be conducted in accordance with applicable Australian legislation, including:

  • Relevant state or territory civil and common law statutes governing contracts and obligations;
  • The Australian Consumer Law, regulating online services, digital contracts, and consumer protections;
  • Other applicable procedural statutes governing civil litigation and evidence.
  • All content created by ChalkyPapers is the intellectual property of ChalkyPapers.com, its suppliers, affiliates, subsidiaries, or partners. Such content is protected under Australian copyright law, including the Copyright Act 1968 (Cth), and applicable international copyright treaties.
  • All software, code, and other technological components used to operate and support the ChalkyPapers platform are the property of ChalkyPapers.com or its licensors and are similarly protected under Australian copyright law and international intellectual property agreements.
  • Users may not copy, reproduce, distribute, or create derivative works from any content or software on ChalkyPapers without explicit written permission from ChalkyPapers or the relevant rights holder.
